Patent Registration ProcessÂ
Filing a patent is a formal procedure that grants inventors exclusive rights over their inventions. This registration allows inventors full authority to control the use, manufacturing, and sale of their products, services, or technologies, preventing unauthorized individuals or entities from exploiting their creations.
Documents Required for Patent Registration
To successfully apply for patent registration, the following documents are needed:
- Application Form: Form 1
- Full Specification: Form 2. If complete specifications are not available, a provisional specification may be submitted.
- Speech and Affirmation: Form 3
- Inventor’s Statement: Form 5, which includes a declaration detailing the originality of the invention.
- Proof of Authority: Documentation from the inventor granting the applicant the right to file for patent registration.
- Power of Authority: If a patent agent or legal representative is submitting the application, Power of Authority Form 26 is required.
- Primary Material: Submission of primary documents is necessary for national phase Convention (Paris Convention) or PCT (Patent Cooperation Treaty) applications. These can be provided with the initial submission or within 18 months from the priority date.
- Permission from National Biodiversity Authority: If the application involves biological material sourced from India, permission must be obtained from the National Biodiversity Authority.
- Source of Biological Components: The source or origin of any biological material included in the patent application must be clearly stated in the specifications.
