The registration and protection of designs in India are governed by the Design Rules established in 2000 and 2001. The Design Act replaced the earlier Act from 1911. Since then, the Design Rules have undergone several amendments, with significant updates made in 2008 and 2014. One notable change is the introduction of a new applicant category that recognizes ‘small entities’ as distinct applicants alongside individuals and companies.
Required Documents for Design Registration in India
To successfully register a design in India, applicants must submit the following documents:
Applicant Information: Full name and contact details of the applicant.
Status/Nature of Applicant: Clear identification of the applicant’s legal status, indicating whether they are an individual, a company, or another entity.
Startup Certificate (if applicable): Startups are required to submit a certificate of registration.
Article Description: A detailed description of the article associated with the design, classified according to the prescribed categories.
Visual Representation: A minimum of four views (images or sketches) of the article from different angles must be included with the application.
